1. Service Description

TamgaStudio ("we," "our," or "us") operates an AI Gateway platform that provides developers and businesses with unified access to multiple third-party artificial intelligence models through a single OpenAI-compatible API. Our service routes API requests through a multi-tier failover system for high availability.

By accessing or using TamgaStudio, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the service.

2. Account Registration and Security

You must register for an account to access our services. You are responsible for:

• Maintaining the confidentiality of your account credentials and API keys
• All activities that occur under your account
• Notifying us immediately of any unauthorized use of your account
• Providing accurate and complete registration information

You must be at least 18 years old to create an account. We reserve the right to refuse service, terminate accounts, or cancel orders at our sole discretion.

3. API Usage

3.1 License

Subject to these Terms, we grant you a non-exclusive, non-transferable, revocable license to access and use our API for your internal business purposes or personal projects.

3.2 Rate Limits

API access is subject to rate limits as specified in our documentation. We may adjust rate limits to ensure service stability for all users.

3.3 Credit System

Usage is billed on a prepaid credit basis. Credits are deducted based on actual token usage and model pricing. Deposits are subject to a platform fee as disclosed at the time of purchase. Credits are non-refundable and non-transferable.

3.4 Service Levels

Our multi-provider failover system is designed to maximize uptime, but we do not guarantee 100% availability. We are not responsible for outages or performance issues caused by third-party providers.

4. Prohibited Uses

You agree not to use the service for any of the following:

• Any illegal activity or in violation of any applicable laws or regulations
• Generating, distributing, or promoting hate speech, violence, or discriminatory content
• Attempting to circumvent rate limits, authentication, or security measures
• Reverse engineering, decompiling, or disassembling our platform
• Interfering with or disrupting the integrity or performance of our services
• Using the service in connection with any competitive benchmarking or model extraction
• Reselling or redistributing API access to third parties without written authorization
• Uploading or transmitting viruses, malware, or any malicious code

5. Third-Party Model Providers

TamgaStudio acts as an intermediary that routes your requests to third-party AI model providers. Important acknowledgments:

• We do not own, host, or operate the underlying AI models
• Each third-party provider has its own terms and acceptable use policies that apply to your use of their models
• We are not responsible for the content generated by third-party models
• Model availability, pricing, and performance may change at the provider's discretion
• Your use of models may be subject to additional terms imposed by the respective provider

6. Intellectual Property

The TamgaStudio platform, including its name, logo, design, documentation, and proprietary code, is our intellectual property. You retain all rights to the data and content you submit through our API. We do not claim ownership over model outputs or your input data.

7. Account Termination

We may suspend or terminate your account immediately without prior notice if:

• You violate these Terms of Service
• Your use of the service poses a security risk to our platform or other users
• Your account has been inactive for a period of 12 consecutive months
• We are required to do so by law or regulatory authority

Upon termination, your right to use the service ceases immediately. Any unused credits are forfeited unless the termination is by our fault. You may terminate your account at any time by contacting support.

8. Limitation of Liability

To the maximum extent permitted by law, TamgaStudio and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, arising out of or in connection with your use of the service. Our total liability for any claim arising from these Terms shall not exceed the total amount paid by you to us in the 12 months preceding the claim.

9. Disclaimer of Warranties

The service is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not guarantee that the service will be uninterrupted, error-free, secure, or that all models will be available at all times. We are not responsible for the accuracy, quality, or legality of content generated by third-party AI models.

10. Indemnification

You agree to indemnify, defend, and hold harmless TamgaStudio, its officers, employees, and agents from any claims, damages, losses, liabilities, and expenses arising from your use of the service, violation of these Terms, or infringement of any third-party rights.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Republic of Turkey. Any disputes arising from these Terms shall be resolved in the courts of Istanbul, Turkey.

12. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes via email or platform notice. Continued use of the service after changes become effective constitutes acceptance of the new Terms. If you do not agree with the changes, you must stop using the service and may terminate your account.
